Check On Me is a personal safety and wellness application designed to help individuals who live alone, older adults, individuals who may require periodic check-ins, and other users who want an additional layer of safety and support.
The application allows a user to designate trusted family members, friends, caregivers, or other trusted contacts who may receive SMS notifications when a scheduled check-in is missed.
These SMS messages are intended to provide safety-related notifications and are not marketing or promotional messages.
This SMS Opt-In and Consent Policy explains how Check On Me obtains, records, manages, and respects consent from individuals who receive SMS messages through the application.
Check On Me sends transactional and safety-related SMS messages associated with a user's account and configured safety/check-in activity.
Depending on the user's settings and circumstances, messages may include:
Check On Me does not use these safety notifications to send advertising, promotional offers, or unrelated marketing content.
Check On Me requires the individual who will receive SMS messages to provide consent before safety-related SMS messages are sent to their mobile phone number.
A Check On Me user may identify a family member, friend, caregiver, or other trusted person as an emergency or check-in contact within the application. However, entering another person's phone number into the application does not, by itself, constitute consent from that person to receive SMS messages.
Where required, the designated contact will be asked to provide their own consent before Check On Me begins sending SMS notifications to that phone number.

Only after the required consent has been obtained will Check On Me send ongoing SMS safety notifications to that contact.
Consent is voluntary and is not a condition of purchasing any goods or services.
Consent to receive Check On Me SMS messages applies specifically to messages sent by Check On Me regarding the safety/check-in service.
Check On Me will not sell, rent, or transfer SMS consent to third parties for their own marketing or promotional purposes.
Consent to receive Check On Me messages does not constitute consent to receive unrelated marketing messages from other companies or organizations.
Each recipient's consent is treated independently. Consent provided by one individual does not constitute consent from another individual.
Message frequency varies depending on the Check On Me user's configured check-in schedule and whether a check-in is missed.
For example, a designated contact may receive an SMS when the person they are monitoring does not respond to a scheduled check-in.
Check On Me does not send a fixed number of promotional messages per day or month. Safety-related message frequency is determined by the check-in schedules and events configured by the Check On Me user.
In normal circumstances, a contact may receive no messages if all scheduled check-ins are successfully completed.

SMS messages sent through Check On Me will clearly identify Check On Me as the sender or service responsible for the notification.
Recipients will be able to understand that the message relates to the Check On Me safety/check-in service.
Recipients may withdraw their consent to receive Check On Me SMS messages at any time.
A recipient may reply "STOP" to a Check On Me SMS message to stop receiving future SMS messages from the applicable Check On Me messaging service.
Other standard opt-out keywords supported by the messaging provider may also be recognized.
Once a recipient has opted out, Check On Me will not intentionally send additional non-essential SMS messages to that recipient unless the recipient subsequently opts back in or messaging is otherwise permitted by applicable law or regulatory requirements.
Recipients may also request removal from SMS notifications by contacting Check On Me support.
If a recipient later wishes to resume receiving messages, they may be required to provide affirmative consent again through the Check On Me application or another supported re-opt-in process.
Recipients may reply "HELP" to request information about the Check On Me SMS service where supported.

Check On Me will provide information regarding the purpose of the SMS messages and available opt-out options.
Standard message and data rates may apply depending on the recipient's mobile carrier and wireless plan.
Check On Me does not control mobile carrier charges, fees, network availability, or message delivery times.
Carriers are not liable for delayed or undelivered messages.
Check On Me is designed to provide an additional safety and check-in mechanism. It is not an emergency response service and should not be relied upon as a replacement for emergency services, caregivers, medical professionals, or direct human assistance.
SMS delivery may be delayed, unavailable, or unsuccessful because of mobile network conditions, carrier restrictions, device settings, lack of service, or other technical circumstances.
Users should contact appropriate emergency services directly when an immediate emergency exists.
Check On Me maintains records of SMS consent and related preferences as appropriate to demonstrate compliance with applicable messaging requirements.

These records may be retained for as long as reasonably necessary to demonstrate compliance with applicable laws, regulations, carrier requirements, and messaging-provider requirements.
Check On Me respects the privacy of users and designated contacts.
Mobile phone numbers collected for SMS notifications will be used for the purposes described in this policy and the Check On Me Privacy Policy.
Check On Me will not sell or rent mobile phone numbers to third parties for their own marketing purposes.
Mobile phone numbers and SMS consent information will not be shared with third parties for their own promotional or marketing messaging.
Information may be shared with service providers that assist Check On Me in providing its services, including SMS and telecommunications providers, where necessary to deliver the requested messages and operate the service.
Users and designated contacts may update their SMS notification preferences through available Check On Me settings or by contacting Check On Me support.
If a designated contact withdraws consent, Check On Me will update the contact's SMS consent status and prevent future non-essential SMS notifications from being sent to that recipient.
If the contact is subsequently added again as a designated contact, Check On Me may require the individual to provide consent again before SMS notifications resume.
Consent to receive Check On Me safety notifications is not consent to receive marketing or promotional communications.
Check On Me will not use safety-related SMS consent as a basis for sending unrelated advertisements, sales messages, promotions, or third-party marketing communications.
Any future marketing SMS program, if introduced, will require a separate consent process where required by applicable law.
Check On Me is committed to complying with applicable telecommunications, privacy, consumer-protection, and messaging requirements in the jurisdictions in which SMS messages are sent.
Check On Me will follow applicable requirements concerning consent, message identification, opt-out requests, help requests, message content, and the handling of recipient preferences.
The service may use Twilio or another telecommunications provider to deliver SMS messages. Check On Me will follow applicable provider requirements, including requirements concerning opt-in, opt-out, HELP, STOP, and consent records.
